Terms of Service

1. Acceptance of Terms

By accessing and using the BLIND website (blindglasses.com.br) or purchasing through any of our authorized marketplace channels, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Use of the Platform

BLIND is an e-commerce platform offering sunglasses and related accessories. You may use our platform to:

  • Browse our product catalog.
  • Place orders and complete purchases.
  • Contact customer support.

You agree not to: misuse the platform; attempt to access non-public areas; reverse-engineer the platform; introduce malicious code; or use the platform for any unlawful purpose.

3. Orders and Payment

  • All prices are displayed in Brazilian Real (BRL) and include applicable taxes unless stated otherwise.
  • Payments are processed by Stripe, a PCI-DSS Level 1 certified provider. We do not store your payment details.
  • An order is considered confirmed only after payment authorization is received.
  • We reserve the right to refuse or cancel any order in cases of suspected fraud, pricing errors, or product unavailability. In such cases, any payment will be refunded in full.

4. Shipping and Fulfillment

  • Orders are dispatched within the timeframe stated on the product page, typically 1–5 business days.
  • Delivery times depend on the carrier and destination. Tracking is provided for all orders.
  • BLIND is not responsible for carrier delays caused by customs, weather, or other events outside our control.
  • Risk of loss passes to the buyer upon delivery to the carrier.

5. Returns and Refunds

Under the Brazilian Consumer Protection Code (CDC), you may return products purchased online within 7 days of receipt for any reason. Defective products may be returned within 30 days. Items must be unused and in original packaging. Refunds are issued through the original payment method within 10 business days.

6. User Responsibilities

You are responsible for:

  • Providing accurate, current, and complete information at checkout.
  • Maintaining the confidentiality of any account credentials.
  • All activity that occurs under your account.
  • Complying with all applicable laws when using our platform.

7. Intellectual Property

All content on this platform — including the BLIND name, logo, product designs, photographs, text, and code — is the property of BLIND or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or create derivative works without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, BLIND shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of your use of the platform. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

9. Third-Party Services

Our platform integrates with third-party services (Stripe, logistics carriers, marketplaces such as TikTok Shop, Mercado Livre, and Shopee). These services are governed by their own terms and privacy policies. BLIND is not responsible for their practices.

10. Modifications

We may modify these Terms at any time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the platform constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of São Paulo, SP, Brazil, except where consumer protection law provides otherwise.
